Terms of Service

These Terms govern your use of DialMe — infrastructure for paid one-to-one video calls between creators and their fans. By creating an account or using the app, you agree to them. Please read them carefully, as they include a binding arbitration agreement, a limitation of our liability, and your agreement to indemnify us.
01Introduction
These Terms of Service (“Terms”) form a legally binding agreement between you and DialMe LLC (“DialMe,” “we,” “us,” or “our”) that governs your access to and use of the DialMe mobile applications, website, and all related features and services (collectively, the “Service”).
DialMe is infrastructure for paid one-to-one video calls between creators and the fans who follow them. Creators bring their own audience and share their own links and profiles; we provide the payment, call, and messaging experience. DialMe is not a marketplace or a discovery platform — we do not feature, rank, promote, or help fans find creators. Please read these Terms carefully, as they include a binding arbitration agreement and class-action waiver, a limitation of our liability, and your agreement to indemnify us.
02Acceptance of agreement
By creating an account or accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
By using DialMe, you agree to these Terms. If you are accepting on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
03Definitions
“Creator” means a user who offers paid video calls through the Service and is eligible to receive payouts. “Fan” means a user who pays to connect with a creator through a call. “Content” means any text, images, audio, video, profile information, messages, or other materials made available through the Service.
“Platform fee” means the service fee DialMe retains from amounts paid for a call. “Payout” means the transfer of a creator’s earnings to their connected payment account. “Call recording” means a recording made on our servers solely for trust, safety, and dispute-resolution purposes, as described below.
04Eligibility
The Service is intended solely for individuals who are at least eighteen (18) years of age. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.
The Service is not directed to children, and we do not knowingly collect personal information from anyone under 18. If we learn that a person under 18 has registered, we will terminate the account and delete the associated data in accordance with our Privacy Policy.
We may require you to verify your age and identity at any time, including through a third-party verification provider, and may suspend access until verification is complete. Some jurisdictions require age verification to access adult-oriented services; where that applies, you agree to complete it.
05Geographic availability, sanctions, and export controls
DialMe is operated from the United States and may not be available, or may be restricted, in some locations. You are responsible for complying with the laws that apply where you are, and you may not use the Service where doing so would be unlawful — including where paid adult-oriented communication services are prohibited.
You represent that you are not located in, and are not a national or resident of, any country or region subject to comprehensive U.S. or other applicable sanctions, and that you are not on any U.S. Government or other applicable restricted-party or sanctions list. You may not use the Service in violation of any export-control or sanctions law, and we may block, suspend, or terminate access to comply with these laws.
06Account registration
Fans sign up with an email magic link — we do not require a password, phone number, or SMS verification. You agree to provide accurate, current information and to keep it up to date. You may not register if you are barred from using the Service under applicable law or have previously been removed or suspended by DialMe.
Creators must complete identity verification and payment-provider onboarding (including Stripe Connect and any required know-your-customer checks) before offering paid calls or receiving payouts. Until that onboarding is complete, payouts for completed calls may be held and, if onboarding is not completed within the applicable window, refunded to the fan.
07Account security and your responsibilities
You are responsible for keeping your account access confidential and for all activity that occurs under your account. Notify us immediately at help@dialme.chat if you become aware of any unauthorized access or other breach of security.
You may not share, sell, transfer, or license your account to any third party. You are solely responsible for your interactions with other users, including all calls and messages, and you agree to use the Service only for lawful purposes and in accordance with these Terms.
08How DialMe works
A fan can open a creator’s public profile from a link the creator has shared and start a free first message to open a chat. The creator replies in their own time with a custom price and duration for a call. The fan accepts and pays to connect. Creators may also generate a single-use, custom-priced link and send it directly to a specific person, who pays on a one-page checkout and is then taken into the call experience.
Calls are live, one-to-one video calls powered by our third-party real-time infrastructure provider. Prices are set by the creator and shown to you before you pay; DialMe does not advertise or set call prices. Fans may keep their camera off during a call, and a creator cannot require a fan to turn their camera on.
DialMe provides the platform that enables a call; the agreement for any given call is directly between the fan and the creator, and DialMe is not a party to it. We do not control, and are not responsible for, whether or how a call takes place.
We may add, modify, suspend, or discontinue any part of the Service at any time, subject to applicable law.
09Payments and pricing
Payments are processed through Stripe, including major credit and debit cards, Apple Pay, and Google Pay. Prices are shown in the currency displayed before you pay, and any applicable tax will be added. DialMe retains a platform fee from amounts paid for a call; the remainder is the creator’s earnings, less any applicable processor fees, taxes, refunds, or chargebacks.
Creator payouts are made to the creator’s connected Stripe account. You are responsible for all taxes arising from your use of the Service or your earnings. Creators are independent and responsible for reporting and remitting their own taxes. If you pay through the Apple App Store or Google Play, billing is also subject to the applicable store’s policies.
10Charges, refunds, and call completion
When you pay for a call, your card is authorized but not charged. You are charged only when the call is completed — that is, when the call timer reaches zero or a participant ends the call after the creator has joined. Calls are billed on an all-or-nothing basis: there are no partial or pro-rated charges.
If the creator never joins within seventy-two (72) hours of your payment, the authorization is released and you are not charged. If you leave before the creator joins, the authorization is released and you are not charged. If a call is interrupted, it pauses and either participant can re-enter for the remainder of the 72-hour window.
Tips, where available, are charged immediately and are non-refundable gifts. Except for the authorization releases described above and any rights you have under applicable law, completed calls are non-refundable. If you initiate a chargeback, we may use trust-and-safety records to respond to the dispute, and we may suspend the relevant account pending resolution.
11Creator terms
If you offer paid calls as a creator, you are an independent contractor. Nothing in these Terms creates an employment, agency, partnership, joint-venture, or franchise relationship between you and DialMe, and you may not represent otherwise. You set your own prices and decide whether and when to accept calls, and you are solely responsible for your interactions, content, and conduct.
You are responsible for your own taxes on your earnings. We or our payment processor may require tax information (such as a Form W-9 or W-8) and may issue tax forms (such as a Form 1099-K) where required by law. Payouts are made through your connected Stripe account, and you must complete and maintain Stripe’s onboarding and verification.
You bear the risk of chargebacks, refunds, and payment reversals on your calls. We may deduct these amounts and related fees from your current or future earnings, hold or delay payouts to investigate suspected fraud or policy violations, and recover any negative balance. We may withhold or reverse earnings derived from fraud, prohibited conduct, or any breach of these Terms, and you authorize us to set off such amounts against any balance we owe you.
12Payment processing and stored value
All payments are processed by our third-party payment processor, Stripe. DialMe is not a bank, money transmitter, or payment institution; we act only as a limited agent to facilitate collection of amounts owed to creators and the retention of our platform fee. Your use of payment services is also subject to Stripe’s terms.
Any tips, credits, or in-app balances are prepaid amounts used only within the Service. They have no cash value, are not deposits or bank accounts, are not redeemable for money except as required by law, and are non-transferable. We may apply controls and request information to comply with anti-money-laundering, anti-fraud, and sanctions obligations, and may freeze or reverse funds we reasonably believe are connected to fraud or unlawful activity.
13Affiliate program
DialMe offers an affiliate program that rewards participants with 10% of the net revenue generated by the creators they refer, for the lifetime of the referral. This reward is funded by DialMe and is not deducted from the referred creator’s earnings. Affiliates act as independent contractors, and payouts are made through Stripe. DialMe may modify or discontinue the affiliate program at its discretion.
14Payments outside the platform
Users and creators are strictly prohibited from soliciting, accepting, or making any form of payment outside the DialMe platform for calls, messages, or content exchanged through the Service. Circumventing the platform in this way is a material breach of these Terms and may result in termination.
15Call recordings, trust, and safety
Calls may be recorded on our servers solely for trust, safety, and dispute-resolution purposes. These recordings are accessible only to DialMe’s trust-and-safety team on an audit-logged basis, are not available to creators or fans, and are automatically deleted after ninety (90) days unless retained for an active investigation or dispute. By using the Service, you consent to this recording and retention.
Creators and fans cannot record or download calls through the Service, and we may apply technical measures to limit screen capture. You remain responsible for complying with any recording-consent laws that apply to you.
16License to use the service
Subject to your compliance with these Terms, DialMe grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for your personal use.
You may not, and may not permit any third party to: copy, modify, or create derivative works of the Service; reverse engineer, decompile, or disassemble any part of it except as permitted by law; rent, lease, sell, or sublicense it; use it to build a competing product; use any automated means such as bots, scrapers, or crawlers to access or collect data from it; or circumvent any security, rate-limiting, or access-control measures. This license terminates automatically upon any breach of these Terms or termination of your account.
17User content and ownership
You retain ownership of the Content you create or upload. By submitting Content, you grant DialMe a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, modify for formatting and technical purposes, display, and distribute that Content solely to operate, provide, and improve the Service.
You represent and warrant that you own or have all rights necessary to your Content and that it does not infringe or violate the rights of any third party or any law. DialMe may, but is not obligated to, monitor, review, edit, remove, or refuse to display Content at its discretion. You may report infringing or unlawful Content to help@dialme.chat, and we respond to valid notices in accordance with applicable copyright law.
18Acceptable use
You agree not to use DialMe to: violate any law, regulation, or third-party right; harass, threaten, stalk, defame, or abuse any person; impersonate any person or misrepresent your affiliation; engage in fraud, money laundering, card testing, or chargeback abuse; distribute spam, malware, or malicious code; gain unauthorized access to our systems or conduct denial-of-service attacks; collect or harvest other users’ personal data without consent; or interfere with or disrupt the integrity or performance of the Service.
We may restrict, suspend, or remove accounts that engage in prohibited activity, withhold earnings derived from prohibited activity, and refer matters to law enforcement where appropriate.
19Calls and user conduct
You are solely responsible for how you behave during calls and on the Service. You may not use DialMe — including any call, message, or content — to: (a) commit, facilitate, promote, or organize any illegal activity, or plan or coordinate any unlawful act; (b) display, perform, or solicit nudity or any sexual, explicit, or pornographic conduct; (c) arrange, request, or solicit an in-person or physical meeting with another user; (d) engage in humiliation, degradation, bullying, harassment, intimidation, or abuse of any person; (e) threaten, promote, or depict violence, self-harm, weapons, illegal drugs, or terrorism; (f) hold or distribute hateful or discriminatory content, or extort, blackmail, or defraud any person; or (g) share another person’s private or identifying information without their consent.
You may not show, film, or depict any minor in any way during a call or in any content, whether on camera, in audio, or in shared media. You may not show or depict any person who has not consented — you must have the right and permission of every identifiable person shown or heard during a call. You may not record, capture, or save any call — by video, audio, screenshot, screen-capture, or any other means — and you may not share, post, publish, stream, or otherwise distribute any call, recording, or another user’s content, whether online or anywhere else.
These rules apply to fans and creators alike. We may remove content, suspend or terminate accounts, withhold earnings derived from prohibited conduct, and report violations to law enforcement. Violations involving minors or non-consensual content will be reported to the appropriate authorities.
20Safety, emergencies, and appropriate use
You are responsible for your own safety and surroundings when using the Service. You must not use DialMe — and in particular must not join or take a call — while driving or operating a vehicle or machinery, or in any situation where doing so could endanger you or others. Use the Service only where it is safe and lawful to do so.
The Service is not a substitute for emergency services and cannot be used to contact police, fire, medical, or other emergency responders. If you are experiencing an emergency, contact your local emergency number. Calls and creators are provided for personal entertainment and connection only and do not constitute professional, medical, legal, financial, or psychological advice.
21Content standards
DialMe strictly prohibits nudity and any sexual, explicit, or pornographic content — including in calls, profiles, messages, and uploaded media, and including drawings or overtly suggestive material. You also may not use the Service to create, share, or solicit content that is illegal, that depicts or involves a minor in any way, that is non-consensual, or that otherwise violates the policies of the app stores through which DialMe is distributed.
Creators are responsible for ensuring their content complies with all laws that apply to them. DialMe may publish additional community guidelines and content rules, which form part of these Terms, and may remove content or terminate accounts that violate them.
22Child safety and zero tolerance for exploitation
DialMe has zero tolerance for child sexual abuse and exploitation (CSAE) and for any content or conduct that sexualizes, endangers, or exploits a minor. This is prohibited everywhere on the Service — including in calls, messages, profiles, and uploaded media — and it cannot be waived by anyone.
We report apparent child sexual abuse material and related conduct to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by law, preserve related information, and permanently terminate the accounts involved. To report a child-safety concern, contact abuse@dialme.chat immediately. Our child-safety standards form part of these Terms.
23Reporting, blocking, and moderation
We do not tolerate objectionable content or abusive users. You can report content or behavior that violates these Terms, and you can block another user, using the in-app reporting and blocking tools or by contacting abuse@dialme.chat. Reports should identify the content or user and describe the issue.
We aim to review reports of objectionable content and abusive behavior and to act on them — including by removing content and suspending or ejecting the responsible user — within 24 hours. We may, but are not obligated to, monitor, review, or moderate content and conduct, and we may remove content or restrict accounts at our discretion. Moderating content does not make us responsible for user content or conduct.
24Intellectual property
The Service, including all software, designs, text, graphics, logos, and trademarks (excluding user content), is owned by DialMe or its licensors and is protected by intellectual property laws. The “DialMe” name and logo are trademarks of DialMe and may not be used without our prior written permission.
Except for the limited license granted in these Terms, nothing transfers any intellectual property rights to you. If you provide feedback or suggestions, you grant DialMe an unrestricted, royalty-free right to use them without obligation to you.
25Copyright and DMCA policy
We respect intellectual property rights and respond to notices of alleged infringement under the Digital Millennium Copyright Act (DMCA) and comparable laws. If you believe content on the Service infringes your copyright, send a written notice to our designated agent at legal@dialme.chat that includes: your physical or electronic signature; identification of the copyrighted work and of the allegedly infringing material and its location; your contact information; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner’s behalf.
The person who posted the material may submit a counter-notice containing the information required by law, and we will respond to valid notices and counter-notices as the law requires. We terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
26Third-party services and links
The Service relies on and may link to third-party services, including our payment processor (Stripe), our real-time call infrastructure provider, and the Apple and Google app stores. These are governed by their own terms and privacy policies, and your use of them is at your own risk. DialMe does not control and is not responsible for the content, policies, or practices of any third-party service.
27Privacy and data protection
Our collection, use, and disclosure of personal data are governed by our Privacy Policy, which is incorporated into these Terms. We process personal data in accordance with applicable laws, including the California Consumer Privacy Act (CCPA/CPRA) and, where applicable to users in those regions, the EU and UK General Data Protection Regulation (GDPR).
DialMe is built around fan privacy: creators never see a fan’s email address, real name, phone number, IP address, or precise location. Creator profiles are public because creators choose to share them. California residents have rights to know, delete, correct, and opt out of the sale or sharing of personal information, and users in the EEA and UK have rights of access, rectification, erasure, restriction, portability, and objection. The categories of data we process and the safeguards we apply are described in our Privacy Policy.
29Communications and notifications
By creating an account, you consent to receive communications from us electronically, including service-related messages, transactional notices, and security alerts, primarily by email and through in-app and push notifications. We do not use SMS. With your consent where required, we may send marketing communications, which you may opt out of at any time without affecting service-related messages.
You can manage push notifications through your device settings. You agree that electronic communications satisfy any legal requirement that a communication be in writing.
You consent to transact and to receive records and disclosures electronically under the U.S. E-SIGN Act and similar laws, and you agree that your electronic acceptance of these Terms has the same effect as a handwritten signature. We may give you notice by email, by posting within the Service, or by other reasonable means; you must send legal notices to us at legal@dialme.chat.
30Assumption of risk and release of claims
DialMe is a venue that connects creators and fans. We do not employ, vet, screen, background-check, or endorse any user, and we do not control what is said or shown during a call. Your interactions with other users are solely between you and them, and you participate at your own risk.
To the fullest extent permitted by law, you release and discharge DialMe and its affiliates, officers, directors, employees, and agents from any and all claims, demands, damages, losses, and liabilities of every kind — known or unknown, suspected or unsuspected — arising out of or in any way connected with your interactions or disputes with other users or with any content shown or shared on the Service. If you are a California resident, you expressly waive California Civil Code section 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” You waive any comparable law in other jurisdictions.
31Disclaimers and “as-is” warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.
DialMe does not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that it is free of harmful components. DialMe does not employ creators, does not endorse them, and is not responsible for the conduct, content, or interactions of any user or creator. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
32Limitation of liability
To the fullest extent permitted by law, DialMe and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service.
To the fullest extent permitted by law, DialMe’s total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of the total amount you paid to DialMe in the six (6) months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD $100). These limitations apply regardless of the legal theory and even if DialMe has been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
33Indemnification
You agree to indemnify, defend, and hold harmless DialMe and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your content, your violation of these Terms or any law, your interactions with other users, or your infringement of any third-party right. DialMe may assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense.
34Force majeure
DialMe will not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, governmental action, power or internet failures, telecommunications outages, third-party service failures, pandemics, or cyberattacks.
35Dispute resolution and arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL. Before initiating arbitration, you agree to first contact us at help@dialme.chat and attempt to resolve the dispute informally for at least thirty (30) days.
Except as set out below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this section. You and DialMe agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. You and DialMe waive any right to a jury trial, and the arbitrator may not consolidate more than one person’s claims or preside over any class, collective, or representative proceeding.
Either party may bring an individual claim in small-claims court and may seek injunctive or equitable relief in court to protect intellectual property or address unauthorized access. You may opt out of this arbitration agreement by sending written notice to help@dialme.chat within thirty (30) days of first accepting these Terms; if you opt out, the remaining Terms still apply.
36Governing law and jurisdiction
These Terms are governed by the laws of the State of Delaware and, where applicable, the federal laws of the United States, without regard to conflict-of-laws principles. Consumer-protection rights afforded to California residents and other applicable state-law rights are preserved where required by law.
Subject to the arbitration provisions above, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in these Terms deprives you of the protection of mandatory consumer-protection provisions of the jurisdiction in which you reside, where applicable law so requires.
37Time limit on claims
To the fullest extent permitted by law, any claim or cause of action arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose; otherwise, it is permanently barred.
38Termination
You may stop using the Service and delete your account at any time through your account settings or by contacting help@dialme.chat. We may suspend or terminate your account or access to the Service, with or without notice, if you violate these Terms, create risk or legal exposure for DialMe, engage in fraud or abuse, or for any other reason permitted by law.
On termination, your license to use the Service ends, and creators will be paid any undisputed earnings accrued before termination, subject to verification holds and applicable deductions. Provisions that by their nature should survive termination will survive.
39Changes to these terms
We may revise these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice within the Service or by email. Changes become effective when posted unless otherwise stated, and your continued use of the Service after they take effect means you accept the revised Terms. If you do not agree, you must stop using the Service.
40App store terms
These Terms are between you and DialMe only, and not with Apple Inc. or Google LLC, and those companies are not responsible for the Service or its content. Your license to use the iOS app is a non-transferable license to use it on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
Apple and Google have no obligation to provide maintenance or support for the Service. Any warranty, product-liability, or legal-conformance claims regarding the app are DialMe’s responsibility, not Apple’s or Google’s, to the extent provided by these Terms and applicable law. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
41Region-specific terms for EU and UK users
If you are a consumer in the European Union or the United Kingdom, the following applies in addition to the rest of these Terms, and any mandatory consumer-protection rights you have under local law are not affected. Because a paid call is digital content or a service supplied immediately, you expressly request that we begin performance right away and acknowledge that you lose your statutory 14-day right of withdrawal once the call has been fully performed; for tips or other digital content delivered immediately, you consent to immediate supply and waive the withdrawal right to that extent.
Under the EU Digital Services Act, you can notify us of illegal content using the in-app tools or by contacting abuse@dialme.chat. We act on valid notices, provide a statement of reasons for moderation decisions where required, and give information about how to appeal. Nothing in these Terms requires you to arbitrate, or limits your rights, where local law prohibits it, and EU and UK consumers may bring proceedings in their place of residence under applicable law.
42Severability, entire agreement, and waiver
If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary and the remaining provisions will remain in full force. These Terms, together with the Privacy Policy and any supplemental terms, constitute the entire agreement between you and DialMe regarding the Service and supersede all prior agreements.
Our failure to enforce any provision is not a waiver of our right to do so later, and no waiver is effective unless in writing. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Nothing in these Terms creates any agency, partnership, joint venture, employment, or fiduciary relationship between you and DialMe, and the Terms create no third-party beneficiary rights except for the app-store beneficiaries identified above. Section headings are for convenience only, and the English-language version of these Terms controls.

By creating an account, accessing, or using DialMe, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
